5. AI-Powered Features

• AI Features provide estimates and guidance only, and are not guaranteed to be accurate, complete, or current.
• Bidstitch App, Inc. makes no warranty or representation regarding the accuracy of any AI-generated identification, authentication, or pricing information.
• You assume all risk associated with reliance on AI Features.
• Photos and content you submit to AI Features may be used to train and improve our models, subject to our Privacy Policy.

6. User Content

You retain ownership of the content you submit through the Service ("User Content"). By submitting User Content, you grant Bidstitch App, Inc. a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, distribute, display, and perform your User Content in connection with operating and improving the Service.

You represent and warrant that you own or have the necessary rights to all User Content you submit and that your User Content does not infringe the rights of any third party.

7. Marketplace Transactions

The Bidstitch marketplace enables Users to buy and sell vintage clothing and related items:

• Bidstitch App, Inc. acts as a platform facilitator and is not a party to transactions between buyers and sellers.
• Sellers are responsible for accurately describing items, fulfilling orders, and complying with all applicable laws.
• Buyers are responsible for reviewing listings carefully before making purchases.
• Transaction fees apply as described on the Service. Currently, Bidstitch charges a 10% transaction fee on completed sales. We reserve the right to modify our fee structure with reasonable notice.
• Payment processing is handled by our third-party payment processor.
• Bidstitch App, Inc. may offer dispute resolution assistance but is not obligated to resolve disputes between buyers and sellers.

8. Authentication and Grading Services

Bidstitch may offer authentication and grading services for vintage items. Authentication and grading opinions represent our best assessment based on available information and do not constitute a guarantee of authenticity, condition, or value. Bidstitch App, Inc.'s liability for Authentication Services is limited to the fees paid for the specific authentication in question.

The Service and its original content (excluding User Content), features, functionality, and underlying technology are and remain the exclusive property of Bidstitch App, Inc. and its licensors. The Service is protected by copyright, trademark, trade secret, and other intellectual property laws.

10. Third-Party Services and Links

The Service may contain links to or integrations with third-party websites or services not owned or controlled by Bidstitch App, Inc. We are not responsible for the content, privacy policies, or practices of any third-party services.

11. Termination

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BIDSTITCH APP, INC., ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO BIDSTITCH APP, INC. IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

14. Indemnification

You agree to indemnify, defend, and hold harmless Bidstitch App, Inc. and its officers, directors, employees, agents, affiliates, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses arising out of or related to your use of the Service, your User Content, or your violation of these Terms.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States. Any dispute shall first be attempted to be resolved through good-faith negotiation. If unresolved within thirty (30) days, either party may submit the dispute to binding arbitration administered by the American Arbitration Association. YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on the Service and updating the "Effective Date" above. Your continued use of the Service after the effective date constitutes your acceptance of the revised Terms.
